1. Agreement to Terms

By accessing or using Fab PropIQ ("the Service"), operated by Fab Data Solutions ABN [your ABN] ("we", "us", "our"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

Fab PropIQ is a property data analytics platform that provides aggregated real estate listing information, suburb-level insights, and investment analysis tools for the Australian property market. The Service is provided on a subscription basis.

3. Account & License Keys

• Each subscription provides a single license key for one user.
• You are responsible for keeping your license key confidential.
• Sharing license keys with third parties is not permitted.
• We reserve the right to revoke access if misuse is detected.

4. Subscription & Billing

• Plans are billed monthly or annually as selected at checkout.
• Payments are processed securely via Stripe. We do not store your card details.
• Subscriptions auto-renew unless cancelled before the next billing cycle.
• You may cancel at any time. Access continues until the end of the current billing period.
• No refunds are provided for partial billing periods.

5. Free Trials

• Free trials provide full access for the stated duration (typically 4 days).
• No credit card is required for trial activation.
• Trial accounts are limited to one per person or organisation.
• We reserve the right to modify or discontinue trial offers at any time.

6. Acceptable Use

You agree not to:

• Use automated tools to scrape, copy, or redistribute data from the Service.
• Resell, sublicense, or commercially redistribute the data without written consent.
• Attempt to reverse-engineer, decompile, or access the Service's source code.
• Use the Service for any unlawful purpose.
• Overload or interfere with the Service's infrastructure.

7. Data & Accuracy

• Property data is sourced from publicly available listings and may not be complete or current.
• We do not guarantee the accuracy, completeness, or timeliness of any data.
• The Service is for informational and research purposes only and does not constitute financial, legal, property, or investment advice.
• Undervalue scores, opportunity flags, and all analytics represent potential signals based on publicly available data. They are not recommendations to buy, sell, or invest in any property.
• You acknowledge that property investment carries risk and that past performance or data signals do not guarantee future results.
• Always conduct your own due diligence and consult a qualified financial advisor, property professional, or legal counsel before making any property or investment decisions.
• Fab Data Solutions accepts no responsibility for any financial loss, damage, or liability arising from reliance on data or scores provided by the Service.

8. Intellectual Property

All content, design, code, and data presentation within the Service are the property of Fab Data Solutions. You may not reproduce, distribute, or create derivative works without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications at any time. We are not liable for downtime or data unavailability.

11. Termination

We may suspend or terminate your access if you breach these Terms. You may terminate your account at any time by cancelling your subscription and ceasing use of the Service.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email where possible.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
